India became a member of the Hague Convention of 5 October 1961, which abolished the requirement of legalization for foreign public documents. In line with this, the Ministry of External Affairs (MEA), Government of India, began issuing Apostille Certificates from August 29, 2007.

Apostille attestation is now the only legalization required for documents to be valid in all Hague Convention countries, such as USA, UK, France, Germany, Netherlands, Italy, Australia, and many more.

What is an Apostille?

An Apostille is a square-shaped sticker issued by the MEA, attached to the back of the original document. It certifies the authenticity of the originating authority’s seal and signature without the need for further embassy legalization.

Types of Documents Eligible for Apostille in India

The MEA issues apostille for the following categories:

1. Personal Documents

• Birth Certificate,Marriage Certificate,Death Certificate,Affidavits,Power of Attorney,Divorce Decree

2. Educational Documents

Degree Certificates,Diploma Certificates,SSC/SSLC/Matriculation,HSC/PUC/10+2 Certificates,Transcripts and Mark Sheets

Note: Commercial documents are not covered under the Hague Convention and require Embassy Legalization instead.

Apostille Procedure in India

To obtain an apostille, documents must follow a two-stage authentication process:

Step 1: State Authentication

• Personal Documents & Educational Documents must be attested by the Home Department / General Administration Department of the issuing state. or Mantralaya Mumbai or Sub Divisional Magistrate Signature,

Step 2: MEA Apostille

• Once state authentication is done, the documents are submitted to the Ministry of External Affairs, Patiala House, New Delhi or its outsourced service centers.

• The MEA then issues the apostille sticker, completing the process.

Apostille Validity

• The apostille is valid in all 100+ Hague Convention countries.

• It does not expire but must match the document's validity (e.g., some universities or immigration authorities may require recent apostille).
